Terms of Service
1. Acceptance of Terms
By accessing or using GridHazard, including its website, API, and any reports or data generated by the platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.
These terms apply to all users, including consumers who purchase individual property reports, businesses accessing the API, and any third parties acting on behalf of those users.
2. Description of Service
GridHazard provides property hazard data and risk intelligence reports. Reports are generated from publicly available federal data sources including FEMA, NOAA, USGS, EPA, CAL FIRE, USDA, and others. The service is available via web interface and API.
GridHazard does not provide insurance, underwriting, brokerage, or advisory services of any kind.
3. Not Insurance Advice
GridHazard reports provide property hazard data and general educational information only. Nothing in a GridHazard report constitutes insurance advice, insurance recommendations, or advice to buy, cancel, modify, or decline any insurance product.
Specifically:
- GridHazard is not a licensed insurance agent, broker, advisor, or adjuster in any jurisdiction.
- The identification of a potential coverage gap or risk factor does not guarantee that a specific insurance product exists, is available in your area, or would be financially advantageous for your circumstances.
- The absence of a flagged risk does not guarantee that a property is free from hazards or that your existing coverage is adequate.
- Report findings should not be used as the sole basis for any insurance decision.
All coverage decisions should be made in consultation with a licensed insurance professional who can review your specific policy, financial circumstances, and individual needs.
4. Data Accuracy and Limitations
Reports are generated from publicly available federal data sources. You acknowledge and agree that:
- Federal data sources may contain errors, omissions, or information that is not current at the time of your report.
- Federal sources update on their own schedules — GridHazard does not control or guarantee that any data reflects real-time or current conditions.
- Reports are based on geospatial data analysis and do not reflect a physical inspection of any property.
- Reports do not assess the condition, construction quality, maintenance, or physical characteristics of any structure.
- GridHazard makes reasonable efforts to maintain current, accurate data but does not warrant the completeness, accuracy, or timeliness of any information in any report.
5. Limitation of Liability
To the maximum extent permitted by applicable law:
- GridHazard shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on any report, data, or information provided by GridHazard.
- Reports are provided "as is" and "as available" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- GridHazard's total liability to you for any claim arising from or related to these terms or the service shall not exceed the amount you actually paid for the specific report or service giving rise to the claim.
Some jurisdictions do not allow limitation of liability for certain types of damages. In such jurisdictions, GridHazard's liability is limited to the maximum extent permitted by law.
6. Indemnification
You agree to indemnify, defend, and hold harmless GridHazard, its founders, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the service; (b) your reliance on any report or data; or (c) your violation of these terms.
7. Intellectual Property
All reports, data compilations, scoring methodologies, proprietary indices, site content, and software are the property of GridHazard or its licensors. Nothing in these terms grants you any ownership rights in GridHazard's intellectual property.
- You may use reports for your personal or internal business purposes.
- You may not resell, redistribute, republish, or sublicense reports or GridHazard data to third parties without prior written permission from GridHazard.
- The GridHazard name, logo, and brand marks are trademarks of GridHazard. You may not use them without written permission.
8. Payment Terms
Consumer property reports are priced as displayed on the site at the time of purchase. API and enterprise subscription pricing is as specified in your applicable service agreement.
- All payments are processed by Stripe. By purchasing, you agree to Stripe's Terms of Service.
- Refunds are available within 7 days of purchase if the report contains a material data error attributable to GridHazard. To request a refund, contact support@gridhazard.com with your order details.
- GridHazard does not issue refunds for reports that were generated correctly based on available federal data, regardless of whether the findings match your expectations.
9. Account Termination
GridHazard may suspend or terminate your access to the service at any time, with or without notice, for conduct that violates these terms or is otherwise harmful to GridHazard, other users, or third parties.
You may close your account at any time by contacting support@gridhazard.com. Closing your account does not entitle you to a refund for previously purchased reports.
10. Governing Law and Disputes
These terms are governed by and construed in accordance with the laws of the State of [TODO: confirm state of incorporation — likely Delaware], without regard to conflict of law principles.
Binding arbitration: Any dispute arising from or relating to these terms or the service shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court.
